Risk Assessment

Water Legislation detailed in L8 is covered by, amongst others, the Control of Substances Hazardous to Health Regulations (CoSHH), which relates to the risk from hazardous micro-organisms, including legionella, and also the Health and Safety at Work Act (1974). It applies whenever water is stored and used in a way that may create a reasonably foreseeable risk of Legionellosis including Legionnaires Disease.

The first part of L8 covers the Approved Code of Practice (ACOP) and places responsibility on employers and others to:

  1. Identify and assess sources of risk.
  2. Prepare a scheme for preventing and controlling the risk.
  3. Implement and manage precautions.
  4. Keep records of the precautions implemented.

Air

We can also undertake air hygiene assessments. This should also be checked as under the Workplace (Health, Safety and Welfare) Regulations and in relation to the Control of Substances Hazardous to Health Regulations (CoSHH), an employer should ensure that the workers receive an 'adequate supply of fresh air, free from any impurity'. This should be supplied by machinery that is adequately maintained.

Local Exhaust Ventilation - LEV Testing

LEV systems should follow guidelines on minimum safety requirements issued by the HSE, as detailed in publications HSG193, HSG37 and HSG54. It is the employer's responsibility not only to introduce and maintain an effective LEV system but to be seen to be doing so - which is why keeping records and booking regular testing is so important.

Good air quality in the workplace is not just a matter of comfort - it's a requirement of the Control of Substances Hazardous to Health (CoSHH) Regulations 2002, which stipulates that "all local exhaust ventilation (LEV) systems should be maintained in an efficient state and in good repair, and inspected and tested at 14 monthly intervals".
